Definitions

Unless the context otherwise requires, any words, terms or expressions used in these Terms of Use shall be interpreted in accordance with their ordinary meaning. This is without prejudice to the following provisions:

“Cookies” means a packet of data sent from a web server to a browser and stored on the hard drive of the computer from which the browser is accessing;

“Company” means the current owner of the tvis.pl domain based on the data of the Domain Registrant;

“Personal Data” has the same meaning as assigned to them by the laws on the protection of personal data of Ukraine and the EU;

“Services” means the provision of all services provided by the Company.

“User” or “Users” means any person using the Services provided by the Company and/or any person accessing the Company’s Website for any purpose;

“Website” means the website operated by the Company and having the following url address – https://tvis.pl/.

The Company requires that all visitors to this website developed and controlled by the Company (the “Website”) comply with the following Terms of Use. The Company may change, replace or remove any part of the Site. The Company may also limit certain services or restrict your access without notice.

Users will use the Services only for lawful purposes and in particular will not

The Company also does not provide any guarantees as to the correctness of the communication, presentation or display of the information provided to Users and/or by Users.

The Company excludes, to the extent permitted by law, all warranties related to the Services and in particular does not provide any guarantees as to fitness for a particular purpose and non-infringement of property rights, including intellectual property rights.

The Company also does not provide any guarantees as to the integrity and correctness of the information contained on its Website and as to the services advertised on the Website or advertised and/or made available through websites linked to it.

In particular, with respect to any real estate that may be advertised on the Website, the Company disclaims all liability for its peaceful possession, legal title to it, structural integrity, general conditions and surroundings, and any other conditions that may entail liability.

Furthermore, the Company disclaims all liability for any damage that may be suffered by any User while using the Services. The Company disclaims liability for any misuse of the Personal Data of Users.

Limitation of Liability

In no event shall the Company be liable for any damages to any User.

Applicable law

Any disagreement, issue or dispute arising out of or relating to the use of the Services and/or the application, interpretation or construction of these Terms of Use shall be settled amicably.

If an amicable solution is not reached within thirty sixty (30) days, the disagreement, issue or dispute shall be referred to arbitration in accordance with the laws of Ukraine. The thirty day period shall begin from the moment the Company or the User formally notifies the other party in writing of the existence of the disagreement, issue or dispute.

Indemnity and Release

Users shall release and hold harmless the Company and its parents, subsidiaries, affiliates, officers and employees from and against all claims and expenses, including legal fees, arising from the use of the Services.

Users release the Company and its parent companies, subsidiaries, affiliates, officers and employees from any and all claims, demands, debts, liabilities, damages (actual or consequential), costs and expenses of any kind or nature.

Modification of the Service

The Company has the right at any time and from time to time to modify or discontinue, temporarily or permanently, the services provided by the Company, in whole or in part, with or without notice.

The Company shall not be liable to any User for any modification, suspension or discontinuance of the Services.

Violation of Terms of Use

A violation of these Terms of Use or any other rights of the Company entitles the Company to seek all remedies at law and in equity against the responsible User, including, without limitation, termination of the Services.

The failure of the Company to enforce any right or provision of these Terms of Use shall not constitute a waiver of such right or provision or of any other rights or provisions contained in these Terms of Use.

If a court decides, rules, adjudicates or otherwise holds that one or more of the rights or provisions set forth in these Terms of Use are invalid, the remainder of the Terms of Use shall be enforceable and, to the extent permitted by law, the court shall give effect to the parties’ intentions as reflected in such right or provision that was held invalid or unenforceable.
