Privacy Policy

The following Privacy Policy describes issues related to the use of the portal www.tvis.pl/eng (hereinafter referred to as the “Portal”).

Our goal is to provide you with a sense of security on our Portal, which is why your privacy and the protection of your personal data are very important to us. Please read the summary below carefully, from which you will learn how our Portal works. We assure you that your data will be processed in a transparent and fair manner, and that we will make every effort to treat it with caution and responsibility.

The following Privacy Policy aims to inform you about the way we use your personal data, in relation to which we meet all the requirements of Regulation (EU) 2016/679 EU of the European Parliament and of the Council of 27 April 2016 (hereinafter referred to as “GDPR”).

  1. Administrator’s data

The Administrator of your personal data within the meaning of the Portal is Oles Yasynski – conducting business activity under the name of TVIS Polska sp. z.o.o. (hereinafter referred to as: “Administrator”). In matters concerning the protection of personal data, you can also contact the Administrator via the email address [email protected].

  1. Purposes and legal basis of data processing

Your personal data may be processed by the Administrator on the basis of:

  1. a) necessity to perform the contract or to take action before its conclusion (art. 6 sec. 1 letter b of the GDPR), separately for the purpose of:

(i) providing the newsletter service;

(ii) using training application forms;

(iii) enabling access to materials related to the topics discussed on the Portal;

  1. b) consent (art. 6 sec. 1 letter a of the GDPR), in order to conduct marketing of entities cooperating with the Administrator;
  2. c) legitimate interest of the Administrator (Article 6, paragraph 1, letter f of the GDPR), separately for the purpose of:

(i) marketing of the Administrator’s own products and services, including for analytical and profiling purposes, where the Administrator’s legitimate interest is direct marketing of its own products and services. Data profiling is aimed at preparing an offer of Omni Modo products that takes into account the preferences of Portal users;

(ii) using contact forms provided by the Administrator on the Portal, where the Administrator’s legitimate interest is taking care of Portal users and providing answers to questions asked;

(iii) defense against potential claims, where the Administrator’s legitimate interest is pursuing or defending claims.

  1. Transfer of personal data

Data may be transferred to entities processing it on our behalf on the basis of agreements concluded with the Administrator, but only for the purpose and to the extent necessary to achieve the above-mentioned purposes, including, among others, entities providing IT services or other services to us that ensure the proper functioning of the Portal, where such entities process data only in accordance with the Administrator’s instructions.

We transfer your data only to entities located within the European Economic Area and therefore subject to strict EU data protection regulations, or those that are bound by an appropriate security standard. We do not currently practice or plan to transfer data to third countries.

  1. Period of storing personal data

We process your personal data only for the period necessary to fulfill the purpose of their storage or as long as we are required to do so by law, in particular until the statute of limitations for any claims or the expiry of the archiving obligation resulting from legal regulations, including the obligation to store accounting documents.

In the case of processing personal data for the purpose of providing the newsletter service, using training application forms and enabling access to materials related to the topics discussed on the Portal, your personal data will be processed for the period necessary to provide this service, until you resign from it.

In the case of processing personal data based on your consent, your data will be stored until it is withdrawn. It is possible to withdraw the consents expressed on the website at any time, including the consent to the processing of data for marketing purposes of entities cooperating with the Administrator. Withdrawal of consent to processing will not affect the lawfulness of the processing carried out before its withdrawal.

In the event of processing your data on the basis of the legitimate interest of the administrator, the Administrator will cease processing the data earlier if you effectively object to the processing of the data.

Right to access data

You have the right to obtain information about the personal data we store about you, including a copy of this data.

Right to rectify data

You have the right to request the rectification of your personal data that is incorrect. Taking into account the purposes of processing, you have the right to request the completion of incomplete personal data, including by submitting an additional declaration.

Right to erasure

You have the right to request the erasure of your personal data stored by us in the following cases:

Your personal data are no longer necessary for the purposes for which they were collected,

you have withdrawn the consent on which the processing is based and there is no other legal basis for the processing,

you have objected to the processing and there are no overriding legitimate grounds for the processing or the objection concerns the processing of data for direct marketing purposes,

the personal data have been processed unlawfully,

the personal data must be erased in order to comply with a legal obligation under Union or national law,

the personal data have been collected in connection with the provision of information society services referred to in Article 8 paragraph 1 of the GDPR.

Right to data portability

You have the right to receive the personal data concerning you that you have provided to us in a structured, commonly used and machine-readable format, if the processing of such data is based on consent or a contract and is carried out in an automated manner.

If you request that this data be transferred to another data controller, this will be done if it is technically possible.

Right to restrict data processing

You have the right to request that the processing of your personal data be restricted in the following cases:

you contest the accuracy of the personal data – for a period enabling us to verify the accuracy of this data,

the processing is unlawful and you object to the deletion of the personal data, requesting instead that their use be restricted,

we no longer need the personal data for the purposes of processing, but you need them to establish, pursue or defend claims,

you have filed an objection under Article 21 paragraph 1 to the processing – until it is determined whether the legitimate grounds on the part of the controller override the grounds for objection.

Right to object to the processing

If your personal data is processed on the basis of the legitimate interest of the administrator, you have the right to object to the processing at any time, in accordance with Article 21 of the GDPR.

Right to withdraw consent

You have the right to withdraw your consent to the processing of personal data at any time. Withdrawal of consent to processing will not affect the lawfulness of the processing carried out before its withdrawal.

The security of personal data is a priority for us, however, if you consider that by processing your personal data we violate the provisions of the GDPR, you have the right to lodge a complaint with the President of the Office for Personal Data Protection.

What are cookies and what are they used for?

Cookies are small text files that are saved on your device when you visit the Portal. These files are sent by the website to the browser. Each cookie file has an anonymous identifier and allows to identify the device in whose memory it was saved for a specified period of time (the time after which the cookie file will be deleted). These files are used to improve the operation of the website. Files of this type store information about your choices, thanks to which we can offer improved and personalized functions. How long do we store cookies?

Session cookies remain on your device until you leave the Portal or disable the software (internet browser).
